NAME, IMAGE, AND LIKENESS RELEASE

BEFORE NAP BAR, INC. CAN USE YOUR NAME, IMAGE, AND/OR LIKENESS, YOU MUST GIVE YOUR PERMISSION.

I GIVE PERMISSION TO NAP BAR, INC. AND ITS ASSOCIATES, AFFILIATES, AND/OR SUBSIDIARIES TO USE MY NAME, IMAGE, AND/OR LIKENESS ON NAP BAR, INC. WEBSITE AND ANY MARKETING MATERIALS RELATED TO THE COMPANY.

I FURTHER UNDERSTAND I WILL NOT RECEIVE ANY COMPENSATION NOW AND/OR IN THE FUTURE FOR THE USE OF MY NAME, IMAGE, AND/OR LIKENESS.

LIABILITY WAIVER

In consideration for my use of electronic and virtual reality equipment (“Equipment”), supplied by Nap Bar, Inc (herein “NB”), and for other good and valuable consideration, I hereby agree to the following on behalf and in of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, estate the case of minors my child:

I acknowledge use of the Equipment could entail known or unanticipated risks that could result in physical or emotional injury to myself or to others. It could also result in property loss or damage.
I expressly agree and promise to accept and assume all of the risks existing with my use of, or contact with, the Equipment. My participation in activities relating to the Equipment is voluntary and I am participating in spite of the risks.
I hereby voluntarily release, forever discharge and agree to indemnify and hold harmless NB and its employees, directors, agents, officers, participants (other than myself,) vendors, and agents (“NB Affiliates”) from any and all claims, demands, costs, or causes of action in any way connected with my use of or contact with the Equipment.
I agree to bear all full costs of any bodily injury, property damage or property loss (in part or in full) resulting from my use of, or contact with, not limited to, the Equipment, decor and/or mattress. For clarification, I understand this includes any damage caused to the Equipment, decor and/or mattress while in my possession or control. Where there is such loss or damage, I will be responsible to replacing the Equipment, decor and/or mattress at its current market value within 30 days of the damage or loss.
This waiver is governed by the laws of the State of Texas regardless of any doctrine that might direct otherwise. Any dispute, claim or proceeding arising under this waiver shall take place in Houston, Harris, County. This waiver is the entire agreement of the parties on its subject matter and may only be modified or waived in a writing signed by NB.
I understand I am being given a limited, revocable license to use the Equipment for exhibition purposes only. Equipment may only be used as directed by NB and must be returned immediately upon request.

By signing this document, I agree if any person is hurt or property damaged during my use of, or contact with, the Equipment I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released.
